It is an unfortunate fact that to do business one must protect oneself, the terms and conditions below reflect this. We suggest that in order to protect yourself, and to avoid misunderstandings or future problems, you read these very carefully and make sure you understand them, or ask for clarification before you make a purchase.

Please read this entire document and check back here periodically for updates, amendments, and revisions.

Anyone not agreeing to the Terms of Sale and Terms of Use in their entirety must immediately refrain from using this website AND immediately refrain from using any item(s) purchased from this website or otherwise obtained from CAMLABZ.

The following definitions shall apply throughout these Terms:

The term "CAMLABZ", "BCAM" and "Brett Cameron" are interchangeable.

"Qualified", "trained", "competent" (and similar terms) shall mean a person who either possess a formal degree in a relevant physical science or who has acquired a reasonable level of competence gained by experience in a laboratory setting or trade. "Reasonable level of competence", as well as the decision of whether or not a person has attained that competence, may be determined by CAMLABZ exclusively and at its sole discretion, if so desired by CAMLABZ.

"User" shall mean any person or persons of legal age who access this website, use information which is or was at any time available on this website, and/or purchase merchandise from this website or from any other connection with CAMLABZ.

"Laboratory item(s)" shall include any item whose ostensible use is for scientific, technical, analytical, industrial, and/or laboratory purposes. Examples include but are not limited to: glassware, tubing, support stands, clamps, jack stands, hot plates, pipettes, burettes, beakers, flasks, retorts, microscopes, centrifuges, magnifiers, rock / mineral / fossil specimens, and epoxy adhesives.

"Educational item(s)" shall include any item used for teaching purposes by a trained or competent user. Such items are supplied upon the agreement that untrained adults or minors will use such item(s) or information under the supervision of qualified persons.

"Claim(s)" shall mean any type of demand, action, or lawsuit brought against CAMLABZ for any reason, whether brought on behalf of the User, any third party, multiple parties, or any combination of these.

General:

By using products or services offered by CAMLABZ you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from using CAMLABZ products or services.

These terms and conditions may be amended in whole or in part by CAMLABZ from time to time.

Amendments will be effective immediately upon posting of the amended terms and conditions on this Website.

You are responsible for ensuring you are familiar with the latest terms and conditions.

Your continued use of the CAMABZ products or services represents your agreement to be bound by the terms and conditions as amended.

Speed of Service:

CAMLABZ holds very little stock, Orders are filled from several sources (all who work at their own speed) this tends to make CAMLABZ a slow supplier. If goods are required for a certain date please make that very obvious in the order.

Our comittment to helping you and saving you money where possible along with the offering of a wide range of goods will (we hope) off-set the slower delivery times.

Availability of Goods:

CAMLABZ makes no guarantee that goods offered for sale on this site will be in stock or otherwise available within the timetable requested by the User or any third party. CAMLABZ shall not be liable for any consequence(s) of failure of goods to arrive within the timetable specified, requested, and/or insisted upon by the User and/or any third party.

CAMLABZ shall not be responsible for errors in estimating shipment dates or reporting available stock quantities of merchandise.

Items offered on this website are offered subject to availability.

All orders will be confirmed for availability of items and a credit or refund provided for any money paid.

Due to many of the suppliers also supplying other laboratories, business and schools; Items in stock at the time of ordering may go out of stock before payment clears; in such cases an alternative supplier will be sought, failure of which a refund will be given.

Change of advertised product:

Items supplied may differ to those listed in the catalogue - this may include Brand, Packaging, shape, composition or other factors.

In general these differences are merely cosmetic or minor and have no effect on the products use.

Where a significant change has been made you will be advised and given the option of revising your order.

Information, Procedures, & Articles:

Although the information on this website is thought by its author(s) to be correct according to the best of his/her/their current knowledge, it is not guaranteed to be free of errors or to be suitable for a particular use. All information is provided strictly on an informal basis and should not replace the buyers own research.

Some of the procedures on this website can lead to injury, death, and/or loss if they are carried out improperly or otherwise acted upon.

If the User or any third party finds any of the information on this website to be unsuitable for any purpose, unsafe, inaccurate, and/or harmful, or if the User or any third party suffers financial loss, personal injury, hardship, and/or death from acting on the information on this website, the sole remedy available to the User shall be to refrain from accessing this website and from using the information available on this website. The User shall furthermore hold harmless, indemnify, and otherwise absolve CAMLABZ from any and all Claims.

At your own risk:

Transactions and all other contact between you, suppliers and other users are conducted entirely at your own risk.

You agree that CAMLABZ takes no responsibility or liability for any misconduct of any of its suppliers or users including, without limitation, suppliers or users that are trading under false pretences or who attempt to defraud you.

CAMLABZ gives no undertakings, representations, or warranties in relation to items sold or listed on the Website, including: About ownership of any item; As to the content, safety, description, worthiness, quality, or legality of the items listed on the Website or offered by user or supplier; As to the accuracy or truth of listings; That any item will meet your requirements or expectations; or About the ability of users to complete a transaction, including credit card transactions.

Merchandise, Products, & Tangible Items:

Laboratory items, glassware, and any other tangible goods for sale on this website are offered or sold on an as-is, as-available basis and are not warranted to be available or suitable for any particular use, except in such case as the manufacturer of that particular item already offers an explicit warranty. Where a manufacturer has made an explicit warranty, that manufacturer alone shall be responsible for all obligations or claims regarding merchantability and/or fitness of the item(s) for a particular use.

Any purported use(s) expressed or implied by CAMLABZ are merely opinions or possible examples of how the item(s) could be used by qualified personnel wearing proper safety gear and operating under carefully-controlled laboratory conditions.

To the extent permitted by law, we hereby disclaim any implied or expressed warranties regarding merchantability or fitness for a particular use. The sole remedy available to the User [where accepted by CAMLABZ] shall be refund of the purchase price of the item(s) bought by the User.

Indemnity:

The User agrees to indemnify CAMLABZ and hold CAMLABZ harmless from and against any claim, expense, demand, suit, or loss arising in connection with use or misuse of the CAMLABZ web site(s), information contained on the CAMLABZ web site(s), and/or merchandise obtained from or offered by CAMLABZ. Such indemnity shall extend to the fullest degree not expressly prohibited by law.

Children's Use & Classroom Policy:

The articles, procedures, and laboratory items made available by CAMLABZ are intended for adults who are competent in laboratory techniques and who are able to evaluate scientific / technical information and check it for errors. Where any article, procedure, item, and/or piece of merchandise is described or implied as being suitable for children, supervision by a competent adult is still required.

Though a number of procedures and items available on the CAMLBZ website carry special warnings designed to discourage minors or unqualified adults, the lack of such warnings does not absolve the User from failure to exercise caution, scientific/technical competence, and good judgement.

No advice or information that is obtained by you from CAMLABZ or anyone else shall create any warranty by CAMLABZ that is not expressly stated in the terms and conditions.

Responsibility for the content of advertisements appearing on this Website (including hyperlinks to advertisers' own websites) rests solely with the advertisers.

The placement of such advertisements on the Website does not constitute a recommendation or endorsement of the advertised product or service by CAMLABZ.

Each advertiser is solely responsible for any representation made in connection with its advertisement.

Liability:

You agree that, to the maximum extent permitted by law, any and all liability and responsibility of CAMLABZ to you or any other person under or in connection with these terms and conditions, or in connection with the services, this Website, another user's acts or omissions, or your use of or inability to use, the services or this Website, is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise. CAMLABZ liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.

No Waiver:

If we do not exercise or enforce any right available to us under these terms and conditions, it does not constitute a waiver of those rights.

Partial Invalidity:

If any provision of these terms and conditions becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining terms and conditions, which shall continue in full force and effect.

Refusal of Service:

CAMLABZ reserves the right to refuse service and/or cancel order(s) to anyone, at any time and for any reason, the sole remedy being refund of purchase price.

Severability:

If any provision or subsection of these Terms of Use or its application to any person or circumstance is legally negated or otherwise held invalid and/or inapplicable, such condition shall not take away from, negate or render invalid any other provisions or applications which can still be given effect or continue to exist in the absence of the negated provision(s); thus, the provisions of these Terms of Use are severable.

In the event that any provision(s) or part(s) of any provision is/are severed, there shall in lieu be added a provision as similar in terms to such invalid, stricken, unenforceable, and/or illegal provision(s) or part(s) as possible while still being valid, enforceable, and legal.

Intellectual Property Rights:

You may not without prior written permission from CAMLABZ, in any form or by any means:

1. Adapt, reproduce, copy, store, distribute, print, display, publish or create derivative works from any part of this Website;

2. Commercialise, copy, or on-sell any information or items obtained from any part of this Website.

Privacy:

CAMLABZ collects personal information about you through your use of the Services and the Website.

You agree that CAMLABZ may use this personal information to assist us to provide the Services to you, for internal research purposes, to verify your identity, for promoting and marketing other CAMLABZ products and Services to you, and for any other purpose that you authorise.

We will not sell or allow third parties to access your personal information without your consent*.

We release account and other personal information only when we believe release is appropriate to comply with laws; facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of CAMLABZ, our users, or others.

* Government agencies with statutory roles enabling them to request information from us include but are not restricted to the Police, Inland Revenue Department and Ministry Of Economic Development.

You may contact CAMLABZ to ask whether information has been provided to government agencies.

Prices:

Prices are volatile and may change even week to week making it difficult to keep this website correct, CAMLABZ will contact you with the correct cost of your order for your consideration at the time of your order.

All prices listed on this website are subject to change without notice. Any price difference between that quoted and actually charged will be passed on to the buyer.

CAMLABZ does NOT at this time charge GST on the transaction.

CAMLABZ has no control over the pricing which is usually dependant on the value of the dollar, the price of petrol and the charges imposed by the supplier and government.

Payment:

CAMLABZ works predominantly on a CASH basis unless otherwise agreed.

Orders are paid in advance along with shipping and any additional charges.

CAMLABZ accepts payments via Internet banking/cash deposits or cheques.

Any credit - fund returns will be via Internet banking only.

Please take into consideration bank clearance times, Public holidays and weekends for fund clearance.

It is important to include your REFERENCE/ORDER number with each payment or order as this will ensure faster service.

CAMLABZ accepts no responsibility for delays caused by un-referenced orders/payments.

Returns and Refunds:

For damage in transit see DELIVERY below.

Orders placed for goods not held in stock by CAMLABZ are not generally able to be cancelled and refunded.

Such goods may be on-sold for a fee [usually 10% or $10 whichever is greater] by CAMLABZ on behalf, or the buyer may arrange to sell to a third party.

All goods sold are subject to the terms, conditions and warranties as set out by the suppliers.

As CAMLABZ interprets it, the consumer act does not cover scientific goods as they are not considered normal consumer items. However other legislation applies.

CAMLABZ urges you to be aware of your rights and forms of redress before purchasing from or using the services of CAMLABZ.

Any returned goods (if accepted) are subject to a 10% or $10 (whichever is greater) handling fee by CAMLABZ and whatever (if any) restocking fee as required by the supplier.

Goods returned for ANY reason are returned at the buyers' expense and this cost and the initial postage costs are non-refundable.

Many goods cannot be accepted back due to sanitation or safety concerns, this includes any sterile goods that have been opened, Chemicals and goods for consumption or medical use.

Delivery:

Orders should be dispatched via a traceable option. Nz Post and Courier are the two most common methods.

Where a non-traceable option is chosen, CAMLABZ responsibility for loss or non-delivery will be restricted to affirming date and method sent to the claims office of the carrier.

Delivery time is dependent on many factors and these must be taken into account when ordering. Please allow for weekends, holidays, busy periods and the different speeds of suppliers as an order may be filled by several.

Fulfilment dates are merely targets not contracts unless specified in writing.

The LAW requires that many chemicals be sent via dangerous goods courier, this is out of CAMLABZ or the suppliers' control.

Chemicals will be sent direct where possible to reduce courier charges, however note that any and all costs are passed onto the buyer.

Breakages:

FAILURE TO FOLLOW THIS PROCEDURE EXCLUDES THE POSSIBILITY OF A CLAIM.

Should goods arrive damaged retain the broken item/s together with all packaging and accessories.

Be sure to keep the courier sticker attached to the outside of the parcel.

You must phone the courier company and lodge a claim within seven days of receipt of the parcel.

A customer services representative will provide instructions regarding the uplifting of broken item/s, if required, and will explain the process to be followed. At the same time you MUST also advise CAMLABZ of the damage or loss.

We cannot accept responsibility for goods returned, for any reason whatsoever, which have been inadequately packed (By you) and damaged in transit.

End User Statements (EUS):

Due to the increase of P-labs in Nz, Science equipment is becoming increasingly difficult to obtain. In fact this is possibly one of the reasons you may be looking to buy through CAMLABZ instead of personally.

To this end, and to help make life awkward for these vermin, we voluntarily restrict the sale of some items and chemicals. However we do not want to stop honest people purchasing goods for legitimate purposes, and to this end we have decided on a compromise.

For purchase of goods on our restricted list the buyer must fill out a EUS form stating what they want the goods for and who they are with proof of ID.

This form will be verified and may be lodged with the Police.

While this may seem excessive, we are talking only a few goods and it is likened to buying a gun - if you are not intending to use it to rob or murder then what does it matter that the police know you have one?

Please do not attempt to bargain around this, we are not interested and all attempts will be noted and sent to the Police as a matter of routine.

SAFETY:

Some of the items available are DANGEROUS and it is understood and agreed that by purchasing such goods the purchaser is aware of these concerns.
